Abstract

إن حاجة الناس إلى المعاملات المالية لا تقل أهمية عن حاجتهم إلى الغذاء والكساء، ويتم تحصيل هذه الحاجات بانتظام في الظروف الملائمة من الأمن والعافية والرخاء مما يحقق نوعا من الاستقرار ويحصل المنافع والمصالح لكل من الأطراف المتعاقدين. ولكن قد ينزل بالناس من الأحوال - كالحروب، والمجاعة، والأوبئة - ما يخل بهذا النظام فتضطرب المعاملات المالية وتتعطل المصالح. ومن هذه النوازل التي حلت بالناس ما يسمى ( كورونا) التي غزت العالم فتعطلت كثير من المعاملات المالية. فترتب على ذلك أحكام استثنائية في بعض المعاملات. والمقال الذي سنقدمه يتضمن النظر في بعض الأحكام الاستثنائية لهذه النوازل مع اقتراح بعض البدائل التي تضمن استمرار المعاملات المالية ولو بنسبة تقل معها الخسائر والأضرار People's need for financial transactions is just as important as their need for food and clothin.
