ضمانات مبدأ حرية الاستثمار على ضوء القانون رقم 22 - 18 المتعلق بالاستثمار الجديد

Abstract

بعد أهم الضمانات التي يحبذها المستثمر، حيث أنه قبل اتخاذه لقرار استثمار أمواله في بلد معين ينظر بعد إقرار مبدأ حرية الاستثمار من إلى الحماية والحرية التي يوفرها البلد المضيف للاستثمار. طبعا والجزائر على غيرها من الدول أوجدت منظومة قانونية كاملة لتشجيع الاستثمار أهمها القانون 22 - 18 المتعلق بالاستثمار والذي جاء بالعديد من النقاط التي تساعد على جلب الاستثمار وتضمن ضمانات قانونية وضمانات قضائية متعددة ومتنوعة. The recognition of the principle of freedom of investment is one of the most important guarantees sought by investors. Before deciding to invest their capital in a particular country, investors assess the level of protection and freedom provided by the host country for investment. Algeria, like other countries, has established a comprehensive legal framework to encourage investment, most notably Law No. 22-18 on investment. This law introduces several provisions that facilitate the attraction of investment and provide multiple and diverse legal and judicial guarantees.
