تتناول إشكالية المقال كيفية التوافق بين متطلبات الشريعة الإسلامية التي تستند إلى نصوص دينية وثوابت فقهية، ومتطلبات القوانين الوضعية التي تفرضها الوقائع المستجدة والتطورات المجتمعية والتقنية. ويهدف المقال إلى تقديم إطار عمل يسهم في تحقيق التوازن بين تطبيق الشريعة الإسلامية والتقنين القانوني الحديث مع مراعاة العدالة والمساواة توصل المقال إلى ضرورة وجود آليات حوار مستمر بين الفقهاء والمشرعين، وأهمية صياغة قوانين تأخذ في الاعتبار القيم الإسلامية مع ضرورة التكيف مع التغيرات المجتمعية الحديثة، مما يسهم في تعزيز العدالة الاجتماعية والاستقرار القانوني.
