العقود الذكية في الفقه الإسلامي

Abstract

هذا البحث عبارة عن دراسة مفصلة حول العقود الذكية، التي تمثل تحولا من اللغة العادية إلى لغة الأكواد، من حيث: التعريف، الأركان الشروط، وصولا إلى الحكم؛ ذلك لأن الفتوى تتغير بتغير الظروف والأحوال، والأشخاص، وبما أن الشريعة المحمدية صالحة لكل زمان ومكان، كان لزاما على الباحثين في الفقه الإسلامي أن يتصدوا لهذا التطور الحاصل في مسألة خطيرة من مسائل الفقه، ألا وهي مسألة العقود، ومن بين تلكم الجهود هذا البحث، الذي يركز على الشروط، ومن ثم إسقاطها على هذا النوع من العقود المعرفة حكم الشرع This paper is a detailed study on smart contracts, which represent a transition from normal language to code language (in terms of definition, pillars, conditions, up to judgment); This is because the fatwa changes due to the change of circumstances, conditions and persons, since Islamic sharia is valid for all times and places, it is of great importance for researchers in Islamic fikeh to counter this development as a serious issue of fikeh; which is the contracts issue. This research is among those efforts, which focuses on conditions, and then dropping them on this type of contracts to know the Islamic judgment.
