الاجتهاد القضائي وتفعيل القيم المقاصدية في تنفيذ آثار التفريق القضائي

Abstract

تناقش هذه المداخلة إشكالية تزايد قضايا التفريق القضائي في القضاء الأسري الجزائري وما يترتب عنها من آثار شرعية وقانونية في ظل التحولات الاجتماعية المعاصرة. وتركز على دور الاجتهاد القضائي في تنزيل الأحكام المتعلقة بالتفريق بما يحقق مقاصد الشريعة ويحفظ حقوق أطراف الأسرة، ولا سيما المرأة المطلقة. كما تبرز ضرورة تفعيل القيم المقاصدية في تنفيذ آثار التفريق لتحقيق العدل والاستقرار الأسري. وتخلص إلى تحليل أبرز التحديات القانونية والقضائية التي تعيق تفعيل هذه القيم في الواقع العملي . This paper discusses the growing phenomenon of judicial separation cases within the Algerian family judiciary and the resulting legal and Sharīʿa implications in the context of contemporary social transformations. It highlights the role of judicial ijtihād in implementing rulings related to judicial separation in a manner that fulfills the objectives of Islamic law (Maqāṣid al-Sharīʿa) and safeguards the rights of family members, particularly divorced women. The study also emphasizes the necessity of activating Maqāṣid-based values in the enforcement of the effects of separation to achieve justice and family stability. It concludes by analyzing the major legal and judicial challenges that hinder the effective application of these values in practice.
