Abstract

بينت هاته الدراسة الإطار القانوني لعملية التنقيب عن الآثار الممتلكات الثقافية وكذلك حالات السحب لرخصة التنقيب، وكذلك إجراءات التعويضية عن الممتلكات الثقافية المنزوعة للأشخاص في إطار المنفعة العامة وموقف المشرع الجزائري في حالة اكتشاف ممتلكات ثقافي. كما بين البحث الأركان القانونية الجريمة التنقيب غير المشروع عن الممتلكات الثقافية على مستوى المواقع الأثرية المحمية أو غير المحمية، المصنفة أو غير المصنفة والعقوبات القانونية المقررة في ذلك، وموقف القانون الجزائري من الوسائل التكنولوجية الحديثة المستعملة في ميدان التنقيب عن الممتلكات الثقافية وموقف الشريعة الإسلامية في التنقيب عن الآثار This study showed the legal framework for the excavation of antiquities, cultural property, as well as cases of withdrawal of an exploration license, as well as compensatory measures for cultural property expropriated for people in the public interest and the position of the Algerian legislator in the case of the discovery of cultural property. The research also showed the legal pillars of the crime of unlawful exploration of cultural property at the level of protected or unprotected archaeological sites, classified or unclassified and the legal penalties prescribed therein, the position of Algerian law on modern technological means used in the field of prospecting for cultural property, and the position of Islamic law in Excavation of antiquities.
