الإجراء التطبيقي للتحقيق العقاري طبقا لأحكام القانون 02 /07

Abstract

إن المشاكل التي عرفتها عملية مسح الأراضي، والتأخير الكبير فيها دفع بالمشرع إلى إعداد وإصدار القانون 07-02 المؤرخ 27 فيفري 2007 المتضمن تأسيس إجراء لمعاينة حق المكية وتسليم سندات الملكية عن طريق التحقيق عقاري، والمرسوم التنفيذي رقم 147-08 المؤرخ 19 ماي 2008 يتعلق بعمليات التحقيق العقاري وتسليم سندات الملكية يطبق بالتوازي مع سير عملية المسح العام للأراضي، ويسمح اختياريا، وفي آجال قصيرة للأشخاص من معاينة حقوق الملكية العقارية الخاصة، وتسليم سندات الملكية، ولقد حاولنا من خلال هذه الورقة البحثية تبين مراحل والإجراءات عملية التحقيق العقاري ، أما النتيجة المتوصل إليها أن التحقيق العقاري هو عملية اختيارية تتم بناء على طلب المعني بالأمر ، لذلك فهناك عزوف من قبل المالك عن المطالبة به بسبب ضعف التوعية حوله من جهة وتحمل تكاليفه من طرف الطالب من جهة أخرى، و هذا لا يساعد على تطهير الملكية العقارية The problems experienced by the land survey process, and the significant delay in it, prompted the legislator to prepare and issue Law 07-02 of February 27, 2007 establishing a procedure for examining the right to property and handing over title deeds through a real estate investigation, executive Decree No. 08-147 of May 19, 2008, related to real estate investigations and delivery of title deeds, is applied in parallel with the conduct of the general land survey process, and optionally, and in short periods of time, allows people to view private property rights and hand in title deeds , we have tried through this research paper to show the stages and procedures of the real estate investigation process. As for the result, the real estate investigation is an optional process that is carried out at the request of the person concerned , therefore, there is a reluctance on the part of the owner to claim it due to poor awareness about it on the one hand and its costs being borne by the student on the other hand, and this does not help to cleanse real estate property.
