الوسطية في مصادر التشريع في المذهب المالكي

Abstract

يظهر هذا البحث الوسطية مبدأ أصيلا في الشريعة الإسلامية، تجلى بوضوح في منهج المذهب المالكي الذي جمع بين النقل والعقل، النص والمقصد، الثبات والمرونة. فقد استطاع المذهب المالكي أن يقدم نموذجا فقهيا متوازنا يحقق مقاصد الشريعة، ويراعي حاجات الإنسان المتجددة دون إفراط أو تفريط. وتبرز وسطية المذهب في مصادره الأصولية كعمل أهل المدينة، والمصالح المرسلة، والاستحسان، وسد الذرائع، وقاعدة مراعاة الخلاف، وغيرها. كما تتجلى في قواعده الفقهية الكبرى التي تقوم على رفع الحرج، ودفع الضرر، وتحقيق المصالح العامة. وبهذا التوازن الوسطي قدم المذهب المالكي أنموذجا رائدا للاجتهاد يضمن التيسير والانضباط، والمصلحة والمقصد. This study demonstrates that moderation is an essential and deeply rooted principle of Islamic law, clearly reflected in the methodology of the Mālikī school, which harmoniously integrates transmitted evidence and rational consideration, textual sources and higher objectives, stability and adaptability. The Mālikī school succeeded in offering a balanced juristic model that fulfills the purposes of the Sharīʿah while addressing the evolving needs of human life without excess or neglect. Its moderation appears in its foundational sources, such as the practice of the people of Madinah, unrestricted public interests (al-maṣāliḥ al-mursalah), juristic preference (al-istihsān), blocking the means (sadd al-dharāʾiʿ), and the principle of considering juristic disagreement, among others. It is also evident in its major legal maxims, which are built on removing hardship, preventing harm, and realizing public welfare. Through this balanced approach, the Mālikī school provided a pioneering model of ijtihād that ensures both ease and discipline, and harmonizes benefit with higher objectives.
