Abstract

تعالج مداخلتي هذه موضوع 'وسطية الإمام مالك بين مدرسة الرأي ومدرسة الأثر' لتجيب عن إشكالية يتمحور سؤالها الرئيس حول موقع الإمام مالك من المدرستين وعلاقة ذلك بوسطية مذهبه؟، مستهدفا بذلك وضع الإمام مالك خصوصا ومذهبه عموما في التصنيف العلمي الذي ينسجم وشخصيته ويتلاءم وأصول مذهبه ويعكس فقهه، من خلال قراءة نقدية رصينة تحليلية مقارنة عند الاقتضاء بين مختلف الآراء التصنيفية لمذهب الإمام مالك ومبرراتها، التي واكبت تاريخ المذهب ومآله في القديم والحديث، متوسلا لذلك بالمنهج الاستقرائي والمنهج التحليلي؛ لتكون المعالجة عبر مبحثين رئيسين نخصص المبحث الأول لإبراز موقف مؤرخي تاريخ التشريع من تصنيف الإمام مالك قديما وحديثا؛ بينما نخصص المبحث الثاني لإبراز موقع الإمام مالك بين مدرسة الرأي ومدرسة الحديث، قبل أن نختم المداخلة بخاتمة نضمنها نتائج البحث وتوصياته. This paper addresses the topic of "Imam Malik's Moderation Between the School of Opinion and the School of Tradition," aiming to answer a central question concerning Imam Malik's position within thesetwos chools and its relation to the moderation of hisschool. The goal is to place Imam Malik, in particular, and hisschool, in general, withina scholarly classification thatalignswithhispersonality, is consistent with the principles of hisschool, and reflectshis jurisprudence. This isachievedthrough a rigorous, analytical, and comparative criticalreading, wherenecessary, of the various classifications of Imam Malik'sschool and theirunderlyingreasons. It also examines the different classifications and perspectives that have accompanied the school'shistory and development, both in the past and present. The paperemploysboth inductive and analyticalmethods, dividingitstreatmentintotwo main sections. The first section focuses on the positions of historians of Islamic jurisprudence regarding Imam Malik's classifications, bothpast and present. The second section explores Imam Malik's position between the School of Opinion and the School of Tradition. The paperconcludeswith a summary of the researchfindings and recommendations.
