الحرية النسائية في ضوء مقاصد الشريعة

Abstract

تناقش هذه المداخلة الحراك النسوي المتزايد في المجتمعات الإسلامية في ظل التحولات الاجتماعية والثقافية والاقتصادية المعاصرة، وما أفرزه من مطالب حقوقية متأثرة بالمرجعيات العالمية. وتسعى إلى مقاربة هذه المطالب من منظور مقاصد الشريعة الإسلامية، بوصفها إطارًا كليًا يهدف إلى تحقيق العدل وصيانة الكرامة الإنسانية، للمرأة والرجل على السواء، ضمن توازن دقيق بين الحقوق والواجبات. وتبرز المداخلة أن الشريعة الإسلامية لم تُغفل حقوق المرأة، بل أقرتها وحمتها من صور التهميش والظلم، غير أن الإشكال يظل قائمًا في كيفية استيعاب تطورات الفكر النسوي المعاصر دون الوقوع في ازدواجية المرجعيات أو المساس بالثوابت الشرعية. كما تؤكد على أهمية تفعيل المنظور المقاصدي لبناء نهضة نسائية متوازنة، تستجيب لمتطلبات الواقع وتحافظ في الوقت ذاته على الهوية الإسلامية. وتخلص المداخلة إلى جملة من النتائج والتوصيات التي تسهم في ترشيد الخطاب النسوي وربطه بالمرجعية المقاصدية. This paper examines the growing women’s movement in Islamic societies in light of contemporary social, cultural, and economic transformations, and the resulting rights-based demands influenced by global frameworks. It seeks to analyze these demands from the perspective of the objectives of Islamic law (Maqāṣid al-Sharīʿah), as a comprehensive framework aimed at achieving justice and safeguarding human dignity for both women and men, within a balanced system of rights and responsibilities. The paper argues that Islamic law has not neglected women’s rights; rather, it has affirmed and protected them from marginalization and injustice. However, the core challenge lies in integrating contemporary feminist thought within the Islamic reference framework without falling into duality of sources or compromising fundamental religious principles. The study highlights the importance of activating the maqāṣid-based approach to building a balanced women’s renaissance that responds to contemporary realities while preserving Islamic identity. The paper concludes with a set of findings and recommendations aimed at rationalizing feminist discourse and grounding it within the maqāṣid framework.
