Abstract

يتناول البحث الكلام عن أهم مصدر اعتنى به المحدثون و الفقهاء في بناء الاحكام الشرعية فاصبح موردهم المعين، الذي يلجؤون إليه في معرفة أدلتها التفصيلية من السنة النبوية، وهي "كتب أحاديث الأحكام"؛ التي تفنن الأئمة في التصنيف فيها بين مختصر ومطول، لكن ما لا ينبغي إهماله هو معرفة طرائق التصنيف في هذا الفن، ومنهج التأليف فيه، خاصة لما تعددت مشارب مؤلفيها وشراحها من مختلف المذاهب الفقهية، وقد علم بداهة تأثر الشراحخاصة المتأخرين منهم بالمذهب في طريقة الاستنباط وبيان وجه الاستدلال، لذا وجب بيان سبل وطرق الاستفادة وأخذ الأحكام منها، وهذا كله سيحاول البحث الكشف عنه The research addresses the significance of the sources relied upon by the Hadith Scholars "Al Muhaddithun" and the Jurists "Al-Fuqaha" in constructing Islamic rulings, as they have become their main source for obtaining detailed evidence from the Prophetic Sunnah, which are the "books of hadiths on rulings ." Imams have meticulously classified these books into concise and comprehensive formats. However, one aspect that should not be overlooked is understanding the classification methods in this field and the methodology of Authorship. This is particularly important given the various approaches taken by authors and commentators from different Islamic legal schools. It is well-known that the commentators, especially the later ones, are influenced by their school of thought in their deduction methods and the way they present evidence . Therefore, it is important to outline the ways and methods of deriving and obtaining rulings from these sources. The research aims to uncover all of this
