علم تخريج الفروع على الأصول وأثره في فتاوى الشيخ محمد الطاهر بن عاشور

Abstract

يعتبر تخريج الفروع على الأصول من اهم المسالك التي تتبع في بيان احكام الوقائع المستجدة واللامتناهية عبر الأزمنة والعصور، وربط الفروع الفقهية الموجودة والمنصوصة عن الأئمة بأصولهم وقواعدهم؛ تأصيلا للأحكام الفقهية، وبيانا لأحد أسباب اختلاف الفقهاء، فعله أتباع الأئمة جيلا بعد جيل إلى زمننا المعاصر، فجاء هذا البحث ليقدم أنموذجا من المعاصرين الذين سلكوا هذا المسلك في فتاويهم، ويكشف جانبا مهما من جوانب الشخصية العلمية لعلم من أعلام المقاصد والتفسير؛ حيث تبين هذه الدراسة أهمية هذا المسلك وأثره في فتاوى الشيخ العلامة محمد الطاهر بن عاشور، مما يدل على تضلعه ورسوخ قدمه في مذهب الإمام مالك وإحاطته بأصوله وفروعه Reffering branches to assets is considered as one of the most important courses that is followed in interpreting the endless and emerging events throughout the times and ages, it was done by the followers of the imams a generation after a generation till our contemporary period; this research came to introduce an example of coevals who followed that course in their legal opinions, and it shows an important aspect of the scientific personality for one of the leaders of interpretation and reasoning sciences; this study shows the importance of this course and its impact on the legal opinions of Sheikh Ben Achour, which indicates his knowledge about the doctrine of imam Malek with its assets and branches.
