مقصد الأمن في الشريعة الإسلامية وأثر الإرهاب عليه

Abstract

يتناول هذا البحث موضوعا من أهم موضوعات حقوق الإنسان ألا وهو أثر الإرهاب الدولي على أحد تصنيفات هذا الأخير وهو حق الأمن وذلك بتسليط الضوء عليه من خلال دراسة مقصد الشريعة الإسلامية من حفظ الأمن من خلال ضبط مفهوم لهذا الأخير ودراسة مدى شموليته في الفقه الإسلامي من خلال تتبع تطوره التاريخي عبر الوثائق الإسلامية. ونظرا إلى أن أي دراسة تحتاج إلى متغير مستقل ومتغير تابع فقد ارتأيت في ورقة بحثي هذه إلى ضبط مفهوم الإرهاب في كل من الفقه الإسلامي والقانون بشقيه الداخلي والدولي للوصول إلى موقف الإسلام من الإرهاب ومدى تحريمه له مع توضيح مدى تأثير هذا الأخير على حق الأمن باعتباره حق من حقوق الإنسان This recherche deals with on of the most important human rights topics, which is the effect of international terrorism on one of the classification of the latter,wich is the right of security,by highlighting it by studying the purpose of islamic law from presering secuirity by contolling the concept of the latter and studying the exten of its comprehensiveness in islamic jurisprudence through traking its historical development throu islamic doculents. And considering that any study needs an independent variabe and it is adependent change,Iconsisdred in this research paper to control the concept of terrorism in both islamic jurisprudence and the law, both internally and interntionally ,to reach islam ‘s position on terrorism and the extent of its criminalizatin, while clarifying the extent of the effect of the latter on the right of security as a right of human rights
