مسالك تعليل الأحكام وأثرها في الإجتهادات المعاصرة

Abstract

إن موضوع تعليل الأحكام الشرعية من أهم المباحث الأصولية وأدقها التي يظهر أثرها العملي في دراسة الفقه؛ ذلك أن استنباط الأحكام الشرعية لما يستجد من الوقائع والمسائل مبني عليه، وبناء على هذا جاءت هاته الدراسة، التي تهدف إلى الإجابة عن تساؤل مطروح وهو : ما مسالك التعليل ؟ وما أثرها في الاجتهادات المعاصرة ؟ فتضمنت تعريف مسالك التعليل بأنها الطرق التي يسلكها المجتهد في إثبات العلة، كما تطرقت إلى مسالك التعليل من حيث التعريف وبيان أنواعها، ومذاهب العلماء في حجيتها، وهي النص والإجماع والاستنباط، ويندرج تحت الاستنباط الإيماء والمناسبة والسبر والتقسيم والشبه والطرد والدوران وتنقيح المناط، وختمت الدراسة بذكر ثلاثة أمثلة من النوازل المعاصرة، يتبين فيها تطبيق بعض هذه المسالك في الأحكام الشرعية وهي: حكم استخدام مياه الصرف الصحي في الطهارة بعد معالجتها، وحكم رفع أجهزة الإنعاش عن الميت دماغيا وحكم استخدام الحقن العلاجية أثناء الصوم The subject of reasoning of Islamic rulings is one of the most important and accurate fundamentalist topics, which shows its practical impact in the study of jurisprudence. This is because the deduction of Islamic rulings for new facts and issues is based on it. This study aims to shed light on the ways of reasoning Islamic rulings and their impact on contemporary interpretations. It included the definition of reasoning methods As the approaches the scholars take to prove the effective cause. It also dealt with methods of reasoning in terms of definition, types and of scholars 'opinions in their authenticity which are the text, consensus, and deduction. The deduction includes gesture, benefit, fathoming, division, analogy, alternation , Direct, and the revision of the signifiers. The study ends up with an application of some methods of Islamic rulings on three contemporary jurisprudence emerging issues which are the ruling on using sewage water after treating it in purification, the ruling on removing resuscitation equipment for the brain-dead, and the ruling on using therapeutic injections during fasting.
