Abstract

يحظى الماء بمكانة مركزية في التصور الإسلامي كونه من أبرز الموارد الحيوية التي تقوم عليها الحياة، وارتباطه الوثيق بجميع أبواب التشريع من العبادات التي يعتبر الماء شرطا في صحتها إلى استقامة المعاملات، ومن العادات إلى مقاصد حفظ النفس والنسل والمال. ونظرا لتفاقم أزمة الشح في الموارد المائية وتلوثها وتزايد النزاعات حول تقاسم المياه الذي يفرض ضرورة إعادة قراءة وتحليل الأحكام الفقهية ذات الصلة بمنظور بيئي شامل،تأتي هذه المداخلة والموسومة ب: الحق <<في الماء وحماية البيئة المائية في الفقه الإسلامي: من فقه الطهارة إلى فقه الاستدامة>>، لتعالج الإشكال الرئيسي التالي: إلى أي مدى يمكن للفقه الإسلامي تقديم رؤية شرعية متكاملة تضمن الحق الإنساني في الماء وتؤسس لحماية البيئة المائية بما يحقق الحاجات الفردية ومتطلبات الاستدامة الجماعية؟ Water occupies a central place in Islamic thought, as it is one of the most vital resources on which life depends and is closely linked to all aspects of legislation, from acts of worship that require water to the integrity of transactions and customs and the preservation of life, offspring, and wealth. Given the worsening crisis of water scarcity and pollution and the increasing conflicts over water sharing, which necessitate a re-reading and analysis of relevant jurisprudential rulings from a comprehensive environmental perspective, this presentation, entitled “The Right to Water and the Protection of the Aquatic Environment in Islamic Jurisprudence: From the Jurisprudence of Purity to the Jurisprudence of Sustainability,” The main question is: To what extent can Islamic jurisprudence provide a comprehensive legal framework that guarantees the human right to water and establishes the protection of the aquatic environment in a way that meets individual needs and collective sustainability requirements
