مستجّدات نظام الأوقاف في التشريع الجزائري على ضوء القانون 25-06 المؤرّخ في 23 محرم 1447 الموافق ل 19 جويلية 2025

Abstract

تضّمن القانون 25-06 العديد من المستجّدات المتعلّقة بمنظومة الأوقاف الوطنية، سواء ما تعلّق بتشجيع وتحفيز استثمار الأملاك الوقفية وتنميتها، أو ما يخّص ادراج تصنيفات جديدة للأوقاف، وتضمين عقوبات جزائية خاصّة بالجرائم الماسّة بالأملاك الوقفية، ويهدف القانون 25-06 أساسا إلى تشجيع انفتاح المؤسسة الوقفية وتحديث آليات إدارة الأملاك الوقفية واستثمارها، فضلا عن تعزيز حمايتها والمحافظة عليها، وهو ما سأحاول التطّرق إليه في هذه المداخلة. Law 25-06 included many new provisions related to the national endowment system, whether related to encouraging and stimulating the investment and development of endowment properties, or related to including new classifications of endowments, and including penal sanctions specific to crimes affecting endowment properties. Law 25-06 aims primarily to encourage the openness of the endowment institution and to modernize the mechanisms for managing and investing endowment properties, as well as to enhance their protection and preservation, which is what I will try to address in this intervention
