الاجتهاد الوسطي في المذهب المالكي من خلال منهج الإمام اللخمي في تقرير الأحكام وتنـزيلها

Abstract

من بديع حكمة الله أن خلق الكون على أساس قويم، مبدؤه العدل، ومنتهاه الإحسان، وقد امتثل النبي صلى الله عليه وسلم هذا الجوهر أحسن امتثال، فأرسى قواعد الاعتدال التي تنسجم معه، وسار على نهجه الصحابة والتابعون عليهم الرضوان، حتى انتهى الأمر إلى الإمام مالك الذي ضربت إليه أكباد الأرض من مشارق الأرض ومغاربها، فقرر أروع القواعد وسن أجمل المناهج في تأسيس منهج الاجتهاد الوسطي، ثم استمر النهج مع تلامذته ومن أتى بعدهم، إذ أيقنوا أن الاعتدال مفتاح كل رباح في تقرير الفتاوى والأحكام، ومن بين العلماء ظهرت شخصية تضاربت حوله الآراء، واختلفت الأقلام في بيان حقيقة مذهبه، وهو الإمام اللخمي، وذلك من خلال الفتاوى التي سطرها في كتابه فيما تعلق بتقرير الأحكام وتنزيلها، حتى بلغ شأوا عظيما جعله محل اعتماد عند الشيخ خليل. Among the wondrous aspects of God’s wisdom is that He created the universe upon a firm foundation, whose principle is justice and whose ultimate aim is benevolence. The Prophet ﷺ embodied this essence in the most perfect manner, establishing the principles of moderation that align with it. His Companions and Followers, may God be pleased with them, continued upon this path until the matter reached Imam Mālik, to whom people travelled from the East and the West. He laid down the most remarkable principles and set the finest methodologies in establishing a balanced approach to jurisprudential reasoning. This path continued with his students and those who followed them, for they were convinced that moderation is the key to every success in formulating legal opinions and rulings.

Among these scholars emerged a figure around whom opinions diverged and writings differed concerning the true nature of his legal school: Imam al-Lakhmī. This was evident through the legal opinions he recorded in his book regarding the formulation and application of rulings—an achievement so significant that it earned him a place of reliance in the works of Shaykh Khalīl.
