Abstract

تدور فكرة هذا المقال حول بيان ماهية التنازل عن الحق للغير بعوض مالي، ودليل مشروعيته وطبيعته الفقهية، وأقسامه، كما أبرز الباحث بعض المصطلحات الفقهية القريبة من مصطلح التنازل وبين علاقته بها، وهو ما حاول توضيحه في هذا المقال، وقد جاء المقال في مقدمة ثلاثة مباحث، وخاتمة ، المبحث الأول كان في بيان مفهوم التنازل عن الحق بعوض وعلاقته ببعض المصطلحات الفقهية الأخرى، والثاني في مشروعية التنازل عن الحق بعوض، طبيعة عقد التنازل عن الحق بعوض، وأقسامه، والثالث في نماذج تطبيقية من مسائل الأحوال الشخصية، وأما الخاتمة فقد ضمنها أهم النتائج والتوصيات The idea of this article revolves around the statement of the waiver of the right of others to money, and evidence of its permissibility, nature and sections, as the researcher explained some terms close to the term assignment and its relationship to it. The article is an introduction, three parts and a conclusion. The first part was in a statement of concept Waiver of the right with money and its relationship with some other terms, the second in the legitimacy of waiver of the right with money, and the third in nature of the contract of waiver of the right to money and its sections, and the conclusion in the most important results reached.
