الحماية الجنائية للمرأة من العنف الجنسي

Abstract

تهدف هذه الدراسة إلى معالجة ظاهرة العنف الجنسي ضد المرأة، وذلك من خلال استقراء وتحليل مختلف النصوص القانونية التي أوردها المشرع الجنائي لحماية المرأة من مختلف أشكال العنف الجنسي الموجه ضدها، إذ ينقسم إلى نوعين، عنف معنوي يكون موجه بالأساس إلى المساس بالحياء العرضي للمرأة ، وذلك من خلال مجموعة من السلوكات والأفعال التي لا تستطيل للجسد لكن تنتهك حياءه، وعنف مادي هدفه إشباع الرغبة الجنسية الكاملة عن طريق انتهاك عرض المرأة سواء بالوطء التام الذي يكون بإيلاج العضو الذكري في فرحها، أو الوطء الناقص الذي يتحقق بملامسة مناطق الحياء والعفة لديها دون أن يصل إلى مرحلة الايلاج This study aims to address the phenomenon of sexual violence against women by extrapolating and analyzing the various legal texts, provided by the criminal legislator to protect women from the various form’s of sexual violence directed against them, as it is divided info two types of moral violence, which is mainly directed at honor modesty’s women, through a series of behaviors and actions that do not prolong the body but violate its modesty, and physical violence aimed at satisfying the full sexual desire by violating the women’s indecent, whether by the complete sexual intercourse of penis in her vagina or the incomplete sexual intercourse achieved by touching areas of modesty and chastity without reaching the penetration stag.
