موقف الفقه الإسلامي من تثمير الأملاك الوقفية

Abstract

بات استثمار الأملاك الوقفية أمرًا ملحًا وضروريًا، لما للاستثمار من دور مهم في تثمير الأوقاف وإخراجها من حالة العطالة ومحدودية العمل الخيري إلى ممارسات اقتصادية تكون فيها أكثر نفعا للموقوف عليهم، وفعالية أكثر في العطاء. و قد بدأت الدولة الجزائرية بالاهتمام بالأوقاف منذ عدة سنوات، وأصدرت عدة تشريعات قانونية لتنظيمه وتفعيل دوره. فالأملاك الوقفية تُشكِّل أهميةًاجتماعية واقتصادية كبيرة، إذ يمكن للقطاع الوقفي أن يحقق أي يسد الكثير من الحاجات الاجتماعية، وأن يسهم في التنمية المحلية، وأن يقدم دعما اقتصاديا قويا عن طريق تمويل المشروعات المختلفة، كالتمويل الزراعي المتنوع الذي يتحقق عبر الأراضي الفلاحية الوقفية، و أن يجلب المال ويوفر مناصب شغل للعاطلين، ويُسهم في تحقيق الاكتفاء الذاتي من الغداء. فالاستثمار مهم جدا في القطاع الوقفي، لكن يتطلب ذلك أولا تجاوز أساليبه التقليدية المطبقة قديمًا في المجال الوقفي، ثم البحث عن أنجع الوسائل المعاصرة والآليات المدروسة لإصلاح الأوقاف، وضمان بقائها واستمرارها لتحقيق أكبر عائد لها، التي تصرف على الجهات الموقوف عليها، وبذلك يصبح الوقف آلية تمويلية مستمرة و دائمة تسهم في التنمية الاجتماعية والاقتصادية للبلد. Investing in Waqf properties has become urgent and necessary, due to the important role investment plays in making Waqfs more productive, lifting them from a state of inactivity and limited charitable work to economic practices that are more beneficial for the beneficiaries and more effective in giving. The Algerian state has begun paying attention to Waqfsfor several years and has issued several legal legislations to regulate them and activate their role. Waqf properties hold significant social and economic importance, as the Waqfsector can meet many social needs, contribute to local development, and provide strong economic support by financing various projects, such as diverse agricultural financing achieved through Waqffarmland. It can also generate income, create job opportunities for the unemployed, and help achieve self-sufficiency in food. Investment is very important in the Waqf sector, but this requires first moving beyond the traditional methods previously applied in the Waqf field, then seeking the most effective contemporary means and carefully studied mechanisms to reform Waqfs, ensuring their continuity and sustainability to achieve the greatest return for them, which is spent on the beneficiaries of the Waqf. In this way, Waqf becomes a continuous and permanent financing mechanism that contributes to the social and economic development of the country.
