العرف اللغوي وأثره في فهم الخطاب الشرعي دراسة دلالية تداولية

Abstract

يتضمن هذا المقال بيان مفهوم العرف اللغوي وأثره في فهم الخطاب الشرعي، فأحكام التصرفات وصيغ العقود الناشئة بين الناس نحو "يعت واشتريت وزوجت وطلقت.... وهي ما اصطلح عليه التداوليون بمصطلح الوعديات (2) تفسر بمقاصد لغتهم؛ فالمتكلم عندما يتلفظ بجملة ما في مقام تواصلي معين فإنه ينجز أفعالا معينة من فعل اجتماعي، ففهم هذه الأفعال وتأويلها المنجزة يخضع لمعرفة صور مقاصد العرف كونه حاملا للمعنى المقصود والخطاب الشرعي باعتباره خطاب تكليف نزل بلغة العرب فإن من رام فهمه، يتطلب منه معرفة لغوية دقيقة بلغة العرب شكلا ومضمون وبأساليبها ومنحاها في كلامها، إذ لا يستقيم للمتكلم في كتاب الله أو سنة رسول الله أن يتكلف فيهما ما لا يسعه لسان العرب "(3). لذا ستحاول إبراز دور العرف في فهم الخطاب باعتباره آلية من آليات التأويل لفهم عملية التواصل This article includes a statement of the concept of linguistic custom and its impact on the understanding of the Sharia discourse.
