أثر رعاية المقصد الحاجي في الاجتهاد التنزيلي

Abstract

يهدف هذا المقال إلى بيان الأثر المترتب عن رعاية المقصد الحاجي في الاجتهاد التنزيلي، ويوضح أن علماءنا لم يغفلوا هذا المقصد أثناء عملية فهم النصوص والاجتهاد واستنباط الأحكام وتطبيقها على الحوادث والنوازل والمستجدات؛ فجاء هذا البحث لتجلية هذا الأثر وبيانه، وقد قسمت المقال إلى مبحثين أساسيين: الأول يعنى ببيان حقيقة المقصد الحاجي والاجتهاد التنزيلي، والثاني يختص بأثر رعاية المقصد الحاجي في الاجتهاد التنزيلي، ثم ختمت المقال بذكر نتائج وتوصيات البحث. The purpose of this article is to show the effect of the care of the Legitimate need in the applied diligence, explaining that our scholars did not neglect to observe this objective during the process of diligence and extracting rules and applying them on the new events so the research came to illustrate this effect and to explain it, the research devided into two topics the first one talk about the reality of legitimate need and the applied diligence, the second one talk about the impact of the care of the Legitimate need in the applied diligence then i concluded the article by mentioning the results and the recommendations of the research
