الإماُم أبُو َجْعفَر الَّداُوِد ُّي وَمْنهجه في كتَا ِب الأَْمَوال

Abstract

يعد الإمام أبو جعفر أحمد بن نصر الداودي (ت (402هـ) أحد فرسان المذهب المالكي وأساطينه الكبار، ولا أدل على ذلك من هذه الفتاوى والآراء الفقهية التي تملأ كتب الفقه المالكي، نقلها عنه علماء المذهب الكبار، فكانوا بذلك شهودًا على علو كعبه وسمو منزلته بين أعيان المذهب المالكي، إضافة إلى تضلعه من علوم الشريعة الأخرى كالحديث والتفسير وغيرهما، وما وصلنا من مؤلفاته . أو أقواله . في هذه المجالات دليل قاطع وبرهان ساطع. وكتابه (الأموال) يحتل واسطة العقد في كتب المذهب المالكي المتعلقة بالمعاملات المالية في بلاد المغرب والأندلس، فقد ألفه ليسد به حاجة الناس في زمانه، ويجيب على النوازل التي كانت تحدث للناس وتقتضي جوابا وتأصيلاً ودليلاً من الكتاب والسنة. ألف الداودي هذا الكتاب، وضمنه أرائه واجتهاداته الخاصة واعتراضاته ومناقشاته لمن سبقه ممن ألف في هذا المجال، سواء أكانوا من علماء المذهب أم من غيرهم، وقد أبان بذلك عن ملكة فقهية كبيرة، وعقلية متحررة من التقليد لغيره، إلا ما أسعفه الدليل، وناصره التعليل. وقد قسم الإمام الداودي كتابه إلى جملة أجزاء، تضمن كل جزء جملة من الفصول، بدأها بالمسائل النظرية، ثم انطلق إلى كثير من التطبيقات العملية التي كانت جوابا عن أسئلة كثيرة كانت ترد إليه، أو نوازل تقع حواليه، فكانت إجاباته منظومة من الفتاوى قامت على النظر الفسيح والدليل الصحيح من نصوص الشريعة. Imam Abu Jaafar Ahmad bin Naser Al-Daoudi is considered as one of the most known figures of the Mālikī doctrine, and there's nothing as a strong evidence of that as all the fatwās and his advisory opinions that were passed on through the greatest scientists of the doctrine which served as a great evidence on the high position, he had between his acquaintances from Mālikī doctrine. In addition to that, he mastered other sciences of Sharia such as: Hadith, Tafsir and many others and all of his publications and says that reached us demonstrated a clear proof on that. His book "Al-Amwal" comes in a leading position among the Al-Malki doctrine financial books in the Arab Maghreb and the Andalus. He wrote this book to answer the so many questions and situations that happened to people and which needed a clear answer from the Quran and Sunnah. Al-Daoudi included in this book all of his opinions, discussions and objections towards those who published prior to him in this field, whether they were from the doctrine scientists or from other areas. Al-Daoudi divided the book into chapters and each chapter by turn divided into smaller parts. He started by reviewing theoretical issues, moving to practical applications which served as answers to a lot of incidences and questions that he received. And by that, his answers were all based on his clear perception, the Quran and the Sunnah.
