الضوابط الفاصلة بين الأصيل والدخيل في أصول الفقه

Abstract

يعتبر أصول الفقه من العلوم الشرعية الأساسية، وذلك لأنه القانون الضابط للعلمية الاستنباطية للأحكام الفقهية، ونظرا لهذا الموقع المحوري وبحكم الاحتكاك بالعلوم الأخرى، فقد أدرجت فيه مسائل خارجة عنه، ولفرز الأصيل فيه من الدخيل عليه لا بد من ضوابط منهجية علمية دقيقة تبين ذلك، وقد ارتكزت في هذا البحث على مدارك هي: حد أصول الفقه وموضوعه والغاية المرجوة منه واستمداده والمراحل التي مر بها هذا الفن؛ ومن خلال هذه المدارك تبين أن ضابط المسائل الأصولية الواردة في كتب الأصوليين هي: أن تكون مسألة أصلية إجمالية حقيقية واقعية منتجة لحكم فقهي وأن ضابط المسائل الدخيلة على كتب الأصوليين هي أن تكون فرعية، أو لكونها غير منتجة ولا ينبني عليها عمل، أو لكونها منتجة لأحكام غير فقهية. أما عن عوامل إدراجها فكثيرة منها: الخلاف العقدي بين الأصوليين، وعدم تحرير محل النزاع في المسائل الخلافية، والاسترسال في مسائل خارجة عن أصول الفقه ولها علاقة بأصول الفقه، والغفلة عن الغاية الأصلية لهذا العلم. The fundamentals of jurisprudence is considered to be one of the basic sciences of Shari'a, because it is the law of the scholarly scholarly development of jurisprudential jurisprudence. In view of this pivotal position and the rule of friction with other sciences, it has included matters beyond it. , And based on this study, it is found that the officer of fundamentalist issues contained in the books of the fundamentalists is: to be a genuine issue of genuine real and real productive jurisprudential . And that the officer of the extraneous issues on the books of the fundamentalists is: to be a subsidiary, or because it is unproductive and not based on it, or because it is produced by non-jurisprudential provisions. As for the factors involved, many of them are: the doctrinal dispute between the fundamentalists, the non-liberation of the dispute in the controversial issues, and the transference in matters that are outside the principles of jurisprudence and related to the fundamentals of jurisprudence and negligence on the original purpose of this science.
