حُكم الخُطبة بغير اللُّغة العربيَّة عرضٌ منهجيّ مُقارن

Abstract

تأتي هذه الورقة البَحثيَّة، لدِراسة مسألة من مُهِمَّاتِ الفُرُوعِ الفِقهيَّة، التي تَنَازَعَت حُكمَها مُختلفُ الاجتهاداتِ والمدراسُ المذهَبِيَّة، وفَرَضَت وُجُودها في السَّاحةِ العامَّةِ والفِكريَّة، التي اقتضتها طبيعةُ العَصْرِ بمُقتضياتهِ التِّقنيَّة ومختلف الجِنسيَّاتِ البشريَّة؛ وهي مسألة " الخُطبة بغير اللُّغة العربيَّة ". فتأتي هذه الوَرَقات لتُلَمْلِمَ ما في المسألةِ من آراء العُلماء والنُّقُول، وتَتَبَّعُ ما سَاقُوهُ من أدلَّةٍ شرعيَّةٍ من جِهةِ المنقُولِ والمعقُول، وتُجلِّي توجيهاتهم لأَوْجُهِ الاستدلالِ بالفهم الثَّاقبِ المصقُول، وما كان بينهم من المدافعاتِ والمرافعاتِ والعَول، للخُلوصِ إلى الرَّأي المختار وخُلاصة البحثِ والقول، بحسَبِ ما تُفضي إليه مُحتكماتُ الخِلاف الفِقهيّ وقواعد الأصُول. This research paper comes to study one of the tasks of the branches of jurisprudence, whose ruling was disputed by various jurisprudence and sectarian schools, and imposed its presence in the public and intellectual arena, which was necessitated by the nature of the era with its technical and human requirements. This is the issue of “getting engaged in a language other than Arabic ”. These papers come to gather the opinions of scholars and narrations on the issue, and trace the legal evidence they provided in terms of what is transmitted and what is reasonable, and clarify their directions to the aspects of reasoning with insightful and refined understanding, and what was among them of defenses, pleadings, and reliance, to arrive at the chosen opinion. The conclusion of the research and the statement, according to what the rulings of the jurisprudential dispute and the rules of principles lead to.
