نظرية الزجر في الفقه الأسلامي

Abstract

تناولت الأطروحة نظرية الزجر في الفقه الإسلامي من خلال بيان مفهومه وصوره وأقسامه، اعتمادًا على تحليل النصوص الشرعية واجتهادات الفقهاء، وبيان تنوع أساليبه بين الزجر الحسي والمالي والنفسي ودوره في تقويم السلوك وتحقيق الاستقامة. كما بحثت حضور الزجر في القواعد الفقهية وما تفرع عنها من تطبيقات في مختلف أبواب الفقه، إلى جانب علاقته بالمصادر التبعية للتشريع، ولا سيما المصلحة المرسلة، بما يؤكد مرونة الشريعة وقدرتها على استيعاب المستجدات وتحقيق مصالح الناس. وتطرقت الدراسة كذلك إلى دور الزجر في منع الحيل والتحايل على أحكام الشريعة ومقاصدها. وخلصت الأطروحة إلى أن الزجر يمثل مظهرًا من مظاهر حكمة التشريع الإسلامي ورحمته، ووسيلة لضمان احترام الأحكام وحفظ النظام العام وصيانة المجتمع من الانحراف والفساد، مما يجعل نظرية الزجر نموذجًا تشريعيًا متوازنًا يمكن الإفادة منه في التشريعات الحديثة. This thesis examines the theory of deterrence in Islamic jurisprudence, focusing on its concept, forms, and classifications through an analytical study of Islamic texts and juristic opinions. It explores physical, financial, and psychological deterrence, as well as its role in correcting behavior and promoting social stability. The study also highlights the presence of deterrence in jurisprudential rules, its connection with subsidiary sources of Islamic legislation, particularly public interest (maslahah mursalah), and its role in preventing legal deception and circumvention of Sharia rulings. The thesis concludes that deterrence reflects the wisdom and mercy of Islamic legislation and contributes to protecting society from deviance and corruption. It therefore represents a balanced legal framework from which modern legislation may benefit in preserving public order and social stability
