Abstract: تتناول هذه الأطروحة الأصول الإجرائية للدعوى القضائية في المذهب المالكي، من خلال دراسة مراحل الدعوى، وجلسات المحاكمة، ووسائل الإثبات، وآليات حسم الخصومات وتنفيذ الأحكام. وتهدف إلى إبراز انسجام وتكامل المنظومة الإجرائية المالكية، ومدى استنادها إلى مقاصد الشريعة، ولا سيما المصلحة والعرف. وتخلص الدراسة إلى أن القضاء المالكي قام على ترشيد الخصومات وتحقيق العدل وحماية الحقوق، مع منح القاضي صلاحيات واسعة ومنضبطة. كما تبرز هذه المنظومة نموذجًا يجمع بين الانضباط التشريعي والمرونة التطبيقية، بما يتيح الاستفادة منها في الدراسات المقارنة وتطوير النظم القضائية المعاصرة This dissertation examines the procedural foundations of judicial litigation in the Maliki school of Islamic jurisprudence. It focuses on lawsuits, hearings, evidence, dispute resolution, and the enforcement of judgments. The study highlights the role of public interest and custom in developing a flexible and coherent judicial system based on justice, fairness, and the protection of rights. It concludes that Maliki judicial procedures provide a valuable framework for comparative studies and contemporary legal development.
