القوانين العرفية في منطقة زواوة القرن التاسع عشر : القانون العرفي في قبيلة آيت فراوسن أنموذجا

Abstract

تهدف هذه الدراسة إلى التعرف على القوانين العرفية في قبيلة آيت فراوسن بمنطقة زواوة خلال القرن 19 وفعاليتها في معالجة شؤون السكان، والتي استمدتها تاجماعت من الشريعة الإسلامية والأعراف المحلية للقرى، خصوصا أن هذه الفترة عرفت تغييرا سياسيا تمثل في الاحتلال الفرنسي والذي عمل على تطبيق مجموعة من السياسات حول القوانين العرفية من خلال محاولة فصلها عن الشريعة الإسلامية وربطها بالقوانين الفرنسية، وهيكلة تاجماعت وفق منظور يخدم سياساتها، مع تقليص صلاحياتها، الأمر الذي أدى بالسكان إلى إيجاد حل بديل تمثل في ما عرف "بتا جماعت السرية" التي مارست سلطاتها وقراراتها بعيدا عن أعين السلطات الفرنسية. This study aims to identify the customary laws in the Aït Fraoussen tribe in the Zouaoua region during the 19th century and their effectiveness in addressing the affairs of the population, which the Tajmaat derived from Islamic Sharia and the local customs of the villages. This period, in particular, witnessed a political change represented by the French occupation, which implemented a set of policies concerning customary laws through attempts to separate them from Islamic Sharia, link them to French laws, and restructure the Tajmaat in a way that served its policies, while reducing its powers. This led the population to devise an alternative solution known as the "secret Tajmaat", which exercised its authority and decisions out of sight of the French authorities
