تأثير ظاهرة الإرهاب الدولي على التراث الثقافي العالمي

Abstract

تحظى الممتلكات الثقافية بحماية القانون الدولي نظرا لما تتمتع به من أهمية باعتبارها تراثا إنسانيا مشتركا للبشرية جمعاء، لكن هذه الحماية قد تصبح محل تهديد زمن النزاعات المسلحة، مما يصعب الحد من الانتهاكات التي قد تتعرض لها، خصوصا إن تدخلت أطراف غير نظامية في النزاع كالجماعات الإرهابية التي ساهمت إلى حد كبير في فقدان الكثير من الكنوز الأثرية والتاريخية وهو ما حصل في العراق وسوريا أين قام تنظيم الدولة الإسلامية في العراق والشام المعروف بتنظيم داعش بالاعتداء على والممتلكات الثقافية والتاريخية بالتدمير والنهب والاتجار الغير مشروع لتمويل عملياته الإرهابية، وأمام تفاقم هذه الظاهرة حاول المجتمع الدولي التصدي لتداعيات الإبادة الثقافية للتراث الثقافي العالمي من خلال المنظمات الدولية لاسيما هيئة الأمم المتحدة والمحكمة الجنائية الدولية Cultural property is protected by international law due to its importance as a common human heritage for all of humanity. However, this protection may become threatened during times of armed conflict, making it difficult to limit the violations it may be exposed to, especially if irregular parties intervene in the conflict, such as terrorist groups that have contributed greatly to the loss of many archaeological and historical treasures, which is what happened in Iraq and Syria, where the Islamic State in Iraq and the Levant, known as ISIS, attacked cultural and historical property by destroying, looting and illegally trading it to finance its terrorist operations. In light of the exacerbation of this phenomenon, the international community has tried to address the repercussions of the cultural genocide of the world's cultural heritage through international organizations, especially the United Nations and the International Criminal Court.
